By accessing and using Validate AI ("Service", "Platform", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service ("Terms") apply to all visitors, users, and others who access or use the Service.

If you do not agree to abide by the above, please do not use this Service.

2. Description of Service

Validate AI is an AI-powered platform that helps users validate SaaS ideas and generate landing pages. Our Service includes:

• AI-powered SaaS idea validation and design document generation
• Automated landing page creation using artificial intelligence
• Code generation and project management tools
• Website deployment capabilities through third-party integrations
• Lead capture and analytics features
• Subscription-based access to premium features

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

4. Subscription Plans and Billing

Validate AI offers both free and paid subscription plans:

• Free Plan: Limited to 1 project and 5 chat interactions per project
• Pro Plan: Up to 5 projects and 50 chat interactions per project
• Unlimited Plan: Unlimited projects and chat interactions

Billing for paid plans is processed through Stripe, our third-party payment processor. Subscriptions are automatically renewed monthly unless cancelled. You may cancel your subscription at any time through your account settings or billing portal.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

5. Acceptable Use

You agree not to use the Service:

• For any unlawful purpose or to solicit others to unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose
• To interfere with or circumvent the security features of the Service
• To generate content that violates applicable laws or regulations

6. Content and Intellectual Property

You retain ownership of any content you create using our Service. However, you grant us a license to use, store, and process your content solely for the purpose of providing the Service.

The Service and its original content, features, and functionality are owned by Validate AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

AI-generated content created through our Service is provided "as-is" and you are responsible for ensuring its accuracy, legality, and appropriateness for your intended use.

7. AI-Generated Content

Our Service uses artificial intelligence to generate content, including but not limited to text, code, and design elements. You acknowledge that:

• AI-generated content may not be accurate, complete, or suitable for your specific needs
• You are responsible for reviewing, validating, and modifying AI-generated content before use
• We do not guarantee the originality or uniqueness of AI-generated content
• You should not rely solely on AI-generated content for business or legal decisions
• AI-generated code should be tested thoroughly before deployment

8. Third-Party Integrations

Our Service integrates with third-party platforms including Netlify, Stripe, Firebase, and others. Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for the availability, content, or practices of these third-party services.

9. Disclaimers

THE INFORMATION ON THIS WEBSITE IS PROVIDED ON AN "AS-IS" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, THIS COMPANY:

• EXCLUDES ALL REPRESENTATIONS AND WARRANTIES RELATING TO THIS WEBSITE AND ITS CONTENTS
• EXCLUDES ALL LIABILITY FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THIS WEBSITE
• MAKES NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF AI-GENERATED CONTENT

10. Limitation of Liability

IN NO EVENT SHALL Validate AI, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

12. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Validate AI operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
